Section 3 Offers
An offer can be made orally or in written forms, including the name, price, quality, quantity and specification of the product, the terms of payment, date of delivery, the validity of the offer, etc.
3.1 Firm offer (offer with engagement)
A firm offer is made to a specific person or persons to imply or express a definite intention of the offeror to conclude a contract under a clear, complete and final trade terms.
3.2 Non-firm offer (offer without engagement)
A non-firm offer is an unclear, incomplete offer with an indication of price. It is an offer with reservation; therefore, it can be subject to change free from notice. There is no binding force on the offeror.
A non-firm offer usually bears the sentences like ‘the offer is subject to our final confirmation’. And it does not have term of validity.
